By enacting Law No. 27,675, the Comprehensive National Response to HIV, Viral Hepatitis, Other Sexually Transmitted Infections – Sexually Transmitted Infections – and Tuberculosis – Tuberculosis, the Republic of Argentina declares a comprehensive and intersectoral response in the national public interest Primary Health Care (PHC) strategy that guarantees research, comprehensive and comprehensive prevention, diagnosis, treatment, cure, interdisciplinary assistance (social, legal, psychological, medical and pharmacological) and reduction of risks and harms of stigma, discrimination and criminalization targeting Patients with HIV, viral hepatitis, tuberculosis and sexually transmitted infections.

In accordance with Article 24 of the above-mentioned law, a special retirement system of a special nature is established for persons living with HIV and persons with hepatitis B and/or hepatitis C, in this case as long as this affects their lives or has any impact according to Applicant agencies determine barriers based on criteria established by objective longevity indicators.

Through Decree No. 805/22, the provisions of Law No. 27,675 were approved, providing that the National Ministry of Health will implement the above-mentioned law through the Directorate of Response to HIV, Sexually Transmitted Infections, Viral Hepatitis and Tuberculosis.

Based on this, it is necessary to accurately establish standards and define covered cases as objective life indicators to ensure that hepatitis patients can enjoy the social security benefits stipulated in Law No. 27,675. B and/or C.

Coordination of viral hepatitis, relying on the General Directorate for Response to HIV, Sexually Transmitted Infections, Viral Hepatitis and Tuberculosis, based on the work diseases articulated by the National Agency for Social Security (ANSES), scientific associations and civil society organizations in the above areas , a broad set of criteria has been identified to define the cases covered by the regulations.

The National Agency for the Control of Communicable Diseases, the Undersecretary for Health Strategy and the Secretariat of Health Services have taken the intervention measures of their competent authorities to ensure compliance. The General Administration of Legal Affairs has taken its jurisdiction to intervene.

The measure was enacted using the powers conferred by Ministry Law No. 22,520 and its amendments and supplements.

Article 1 – Approval of “objective living standards and indicators for persons with hepatitis B and/or hepatitis C” to guarantee access to social security benefits provided for in Law No. 27,675 (Annex I (IF-2023)) -122020521-APN -DRVIHVYT#MS) is an integral part of this document in accordance with the provisions of Chapter 7, Article 24 of this Law and its regulatory decrees.
