The ruling concerned, in particular, the surgeons Francesco Giuseppe Biondo, Fabio Pacifico, Roberto Tomasillo – they examined and underlined that they had participated in two emergency operations on a patient in compromised conditions – Lorenzo Fiorito, Raffaele Morelli, Maurizio Russo and Emilio Parente, and anesthetists Francesco Cacavale, Loredana Pisani, Maria Cusano and Barbara Di Lorenzo, defended by lawyers Gerardo Orlando, Angelo Leone, Vincenzo Regardi, Marcello D’Orea, Mario Palmieri, Roberto Pulcino, Agostino Guarante, Natasia Pastor, Roberto Rapallo , Adele Granata.
The 65-year-old had four surgeries from July 7 to July 23 for a gallbladder problem, then his health deteriorated until his heart stopped permanently.
The complaint of the family members, represented by the lawyers Vincenzo Torino and Alfonso Costabile, gave way to investigative activity marked by the autopsy entrusted to the doctors Massimiliano Dell’Aquila and Osvaldo Micera. An examination was ordered by the Public Prosecutor to ascertain the cause of death and the existence of alleged responsibilities, for which some partisan consultants were appointed: doctors Carmine De Rosa (for the victim’s wife and children), Vincenzo Migliorelli , Giovanni Liviero, Noemi Razzano, for sanitary ware.
