The National Administration of Medicines, Food and Medical Technology prohibited this Friday through its publication in the Official Gazette, the marketing of a series of natural supplements.

The Provision 447/2022 establishes the ban on marketing the product throughout the national territory and on online and digital sales platforms: “All Natural Herbal Supplements, brand Shelex – Male Sexual Enhancement, 8 Capsule, Distributed by American Nutraceutical Technology Inc., El Monte, CA 91731, USA”, for lacking product and establishment authorization, resulting in consequently being illegal products.

In its recital, it explains that the proceedings began as a result of a consumer complaint in the Food Sanitary and Nutritional Surveillance Department of the National Food Institute (INAL) regarding the marketing of the product that would not comply with food regulations and in this complaint he was referring to the fact that, according to the consumer, the intake of the investigated product would have caused a rapid increase in blood pressure.

After a series of consultations and investigations in different departments and directorates, it was established that the product is in violation due to lack of establishment and product registrations, resulting in consequently being illegal products and that because it is a product that cannot be reliably and clearly identified as produced, processed and/or fractionated in a specific establishment, it may not be produced in any part of the country, nor marketed or sold in the territory of the Republic.

Also, he maintains that in order to protect the health of citizens before the consumption of illegal products, whenever they are dietary supplements that lack records, the Department of Guidance in Food Regulations of the INAL recommends prohibiting the marketing of the aforementioned foods throughout the national territory.

Meanwhile, the Provision 448/2022 establishes the prohibition of the use, commercialization and distribution throughout the national territory of all batches and presentations, until it is registered in the Registry of Medicinal Specialties, of the product labeled as “BAO JI WAN GINSENG FORTE, GINSENG. Manufactured by: GUANGZHOU WANGLAOJI PHARMACEUTICAL CO. LTD, CHINA. Imported by: GLOBAL PHARMACEUTICAL CORPORATION SAC, Calle Fray Luis de León 479, San Borja, Lima, Peru and by TRADING INTERNATIONAL CORPORATION for Latin America”.

And in its recital it states that the proceedings were initiated by virtue of the fact that Argentine National Gendarmerie reported that in a routine control it seized the product and in a photograph of it, he describes therapeutic indications such as: “decreases physical and mental fatigue”, “excellent anti-inflammation of the kidneys, liver, prostate, ovaries”, “eliminates toxic substances from the body”, “controls anxiety and depression” , “combats sexual impotence” and “excellent digestive”.

In response to a query, the Directorate of Technical Information Management indicated that, at the time of the report, there were no registration records of products in the Register of Medicinal Specialties (REM) of this National Administration with the commercial name BAO JI WAN GINSENG FORTE.

Given the description, it is that the Department considered that the product is in violation since it is not possible to determine if it was prepared under the circumstances indicated by the law and what its true composition is and that it recommended prohibiting the use, distribution and commercialization throughout the national territory of all batches and presentations, until it is registered in the Registry of Medicinal Specialties.
